Shipping Damage Guide
DIMAX INTERNATIONAL POLAND SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ
Transport risk
Where ordered goods are shipped to the Buyer, the Seller bears the risk of accidental loss of or damage to the goods in transit. For a Privileged Buyer (a Consumer or a Privileged Entrepreneur), the risk passes when they, or a third party other than the carrier indicated by them, take possession of the goods. If the goods are damaged or lost in transit, the Privileged Buyer may exercise the rights available in the event of lack of conformity of the goods with the contract, in accordance with § 9 of the Shop Terms and Conditions.
Checking the delivery
We ask the Buyer, or the recipient indicated by the Buyer, to check the delivery promptly upon receipt for completeness and conformity with the delivery documents, and to inform us promptly of any damage or missing items. This helps us pursue claims against the carrier. For a Privileged Buyer, this is a request only. Failing to inspect the delivery or reporting a problem later does not limit their statutory rights.
A Buyer other than a Privileged Buyer must inspect the delivery promptly upon receipt and notify the Seller promptly of any damage or missing items found. Otherwise, the delivery is deemed accepted without reservation.
Types of transport damage
There are two types of transport damage.
1. Visible transport damage
Example: the packaging is damaged or dented, or parts of the goods are sticking out of the packaging.
What to do: note the type of damage (e.g. "packaging damaged", "housing dented") on the consignment note or delivery document and ask the driver to confirm it with their signature. If the driver refuses, please make the note anyway and add: "Driver refused to sign". If you sign on an electronic device, please sign slightly smaller and add the word "DAMAGED" as clearly as possible. Please also ask the driver to mark the shipment as damaged in their system. If possible, take photos documenting the damage. We also recommend drawing up a damage report together with the courier.
2. Concealed transport damage
Example: the box or pallet shows no external damage, but the goods turn out to be damaged once opened.
What to do: we recommend taking photos of the packaging before opening it and photos of the contents immediately after opening. These may be needed to report concealed damage or missing items. Carriers usually accept claims for concealed damage within 7 days of delivery, so please send us a description of the damage together with photos within that period, so that we can report it to the carrier. Missing this deadline does not deprive a Privileged Buyer of their statutory rights.
Please do not start up or use damaged goods, as this may pose a risk to health or property. The Buyer may be liable, in accordance with the law, for damage caused solely by using the goods despite visible damage.
General information
Minor transport damage and small repairs are often resolved by mutual agreement outside the standard transport damage procedure. If the damage is minor, please contact us. There is usually a quick and simple solution.
We handle reports of transport damage as complaints in accordance with § 9 of the Shop Terms and Conditions and respond within 14 days of receipt. Clarifying the matter with the carrier is our responsibility and does not suspend the Privileged Buyer's rights (e.g. replacement, repair, price reduction or withdrawal from the contract).
Delivery to a neighbour is permitted provided that the recipient is notified of it. If the neighbour was not indicated by the Privileged Buyer, the risk of loss of or damage to the goods passes to the Buyer only when the Buyer takes possession of the goods.
